17.2 Traffic System, Legislation, Traffic Control

Traffic System

The traffic system consists of the following factors:

  1. The driver and other road users

  2. The traffic environment

  3. The vehicle

  4. Traffic control

These factors are always present when driving. These factors are variables and the driver must know how to predict chances in them. Traffic accidents are mainly caused by mistakes made by road users.

In the future we will have an increasing number of elderly drivers. According to population estimates in the year 2015 every fifth and in the year 2030 every fourth person living in Finland will be over 65 years old. This fact sets even higher requirements to the driver's ability to predict traffic situations.

Law

The aim of Traffic Law is to give equal right to move safely to all road users.

The law makes traffic predictable, if the road users obey it.

Especially the drivers of motor vehicles must remember that the freedom to move comes with responsibilities.

When you come to full stop, the police usually perform breath alcohol test and asks you to present your driving license and the technical part of the registration certificate. New drivers are part of a more strict traffic offence monitoring system for the first two years.

Traffic Offence

Notification

An oral or written notification of a minor traffic violation.

Parking Ticket

  • The amount to be paid depends on the region.
    For example, in Helsinki the parking ticket is 60 Euros and in the city center of Helsinki it is 80 Euros.

Traffic Fine

  • Infringement EUR 100

  • Pedestrian’s infringement EUR 20

  • Infringement resulting from use of non-motorised vehicle EUR 40

  • Infringement caused by improper use of safety device EUR 70

Breaking the speed limit

If the speed limit indicated by a traffic control device, or the maximum speed for a specific vehicle, is 60 km/h, the driver of a motor vehicle may be issued with a traffic fine as follows for exceeding the speed limit, whether this occurred deliberately or out of carelessness:

1) Limit exceeded by up to 10 km/h, EUR 100;
2) Limit exceeded by more than 10 km/h but no more than 15 km/h, EUR 170;
3) Limit exceeded by more than 15 km/h but no more than 20 km/h, EUR 200.

If the speed limit is more than 60 km/h, the driver of a motor vehicle or tram may be issued with a traffic fine as follows for exceeding the speed limit, whether this occurred deliberately or out of carelessness:
1) Limit exceeded by up to 10 km/h, EUR 70;
2) Limit exceeded by more than 10 km/h but no more than 15 km/h, EUR 140;
3) Limit exceeded by more than 15 km/h but no more than 20 km/h, EUR 170;

However, if a moped exceeds the speed limit by up to 15 km/h, whether this was deliberate or accidental, a EUR 100 traffic fine may be issued.

A traffic fine may not be issued if the speed limit was exceeded on a residential precinct or pedestrian street.

Day-fine

  • Day-fine is calculated according to persons tax-records and based on personal net income.

  • One day-fine is one 60th of the person's monthly mean net income.

  • The more serious the offence, the bigger the number of day-fines (max. 120)

Wrong Parking, Unnecessary Driving and Idling

Not obeying prohibitions and restrictions related to stopping and parking are punishable only if the parking infringement has caused or could have caused serious danger or inconvenience. Otherwise, parking ticket is issued for parking infringement. Unnecessary and disruptive driving and idling infringements may be penalised with a traffic fine.

Driving ban

Driver of a motor vehicle must be imposed a driving ban if the driver is found to be guilty of aggravated endangerment of traffic safety, drunken driving or aggravated drunken driving. Holder on a driving permit has to be sentenced to driving ban:

1) if a driver can no longer fulfill the requirements for a driving license permit;
2) if a driver has not within a time limit set by the police delivered medical certificate or a certificate from an optician or passed a driving test;
3) if a driver has committed a violation of criminal law while driving a motorized vehicle, and if this violation shows aggravated disregard towards traffic safety;
4) if a driver has driven a vehicle without an adequate permit;
5) if a person is guilty, within 12 months, of at least three, or within two years, at least four traffic infringements;
6) if a person has had a driving license for less than two years and within that time is guilty, within a period of 12 months, of at least two, or within two years, of at least three traffic infringements;
7) if a person has had a motorcycle driving license for less than two years, but has no passenger car driving license, and is guilty within 12 months of at least two, or, within two years, of at least three traffic infringements.

The monitoring period is calculated one year or two years retrospectively from the most recent traffic infringement.

Training following driving ban

Persons who have received their first passenger car or motorcycle driving licences will be monitored more carefully than other drivers for two years. They can be banned from driving if they are guilty of one or more traffic crimes or infringements. In order to prevent risk behaviour by such drivers, the driving license will not be returned until extra lessons have been taken.

The lessons concern risk behaviour and its effects on traffic safety. This consists of theory lessons combined with individual assignments and group discussions. The lessons are four hours in duration and may also be completed remotely.

The lessons can be attended in a driving school or under training by a traffic safety sector provider approved by Traficom. The lessons may be attended during the driving ban or after it.

The police will return the person’s driving license once the training has been completed, a document has been submitted to the police proving this, and once the driving ban period is over.

Imprisonment

Letting drunken driver use your vehicle
